Terms and Conditions

1. Scope

These Terms and Conditions apply to direct bookings made through this website or directly with Small Vienna for the temporary accommodation offered in Vienna, Austria.

By making a booking, the guest accepts these Terms and Conditions, the cancellation policy, the house rules and any additional booking information provided before or after confirmation.

2. Booking and Contract

A booking becomes binding once it has been confirmed by us in writing or through the booking system and the required payment has been received or authorised.

The person making the booking must be at least 18 years old and is responsible for all guests included in the booking.

3. Prices and Payment

The total price shown at the time of booking includes the accommodation price and any mandatory fees displayed during the booking process, unless stated otherwise.

Payment terms, due dates and accepted payment methods are shown during the booking process or in the booking confirmation. The booking may be cancelled if payment is not received on time.

Any bank charges, payment provider fees, currency conversion costs or card issuer fees charged to the guest are the guest’s responsibility.

4. Security Deposit

A refundable security deposit may be required. The amount and payment method will be stated during the booking process or in the booking confirmation.

The security deposit may be used to cover damage, missing items, lost keys, excessive cleaning, breaches of house rules or other costs caused by the guest or members of the guest’s party.

If no deductions are necessary, the security deposit will be released or refunded after check-out within a reasonable time, depending on the payment provider or bank processing time.

5. Cancellation Policy

Guests may cancel free of charge up to 60 days before the scheduled check-in date. In this case, 100% of the accommodation price will be refunded.

Cancellations made less than 60 days before check-in are non-refundable, unless otherwise agreed in writing. If we are able to rebook the apartment for the cancelled dates, we may, at our discretion, offer a partial refund after deducting any loss, costs and payment processing fees.

Accommodation bookings are made for a specific date or period. Therefore, where applicable under EU and Austrian consumer law, the statutory right of withdrawal for distance contracts does not apply to such accommodation bookings.

We recommend that guests arrange suitable travel insurance.

6. Check-in and Check-out

Check-in and check-out times are stated in the booking confirmation or pre-arrival information.

Early check-in or late check-out is only possible if confirmed by us in advance. Unauthorised late check-out may result in additional charges.

Guests must provide accurate arrival information and complete any required guest registration before or during check-in.

7. Guest Registration

Guests may be required to provide personal information for legal registration obligations, identity verification, communication, booking administration and compliance with applicable Austrian or local requirements.

Guests must provide correct and complete information. Failure to provide required information may result in refusal of check-in or cancellation of the booking without refund where legally permissible.

8. Use of the Apartment

The apartment may only be used by the number of guests stated in the booking confirmation. Additional guests or visitors are not permitted without prior written approval.

The apartment must be used respectfully and in accordance with the house rules, building rules and applicable laws. Parties, excessive noise, illegal activities, smoking inside the apartment and disturbance of neighbours are not permitted.

Guests are responsible for keeping the apartment, furniture, equipment, artwork and building areas in good condition.

9. Damage and Liability of Guests

Guests are responsible for any damage, loss, excessive cleaning, missing items or costs caused by them or members of their party.

Damage must be reported immediately. We reserve the right to charge reasonable repair, replacement, cleaning or administrative costs.

Guests are responsible for their personal belongings. We are not liable for loss, theft or damage to personal property except where caused by our intentional misconduct or gross negligence.

10. House Rules

The house rules form part of these Terms and Conditions. Guests must comply with all house rules provided before or during the stay.

Serious or repeated breach of the house rules may result in termination of the stay without refund and may lead to additional charges.

11. Changes by the Guest

Any requested changes to booking dates, guest numbers or other booking details are subject to availability and written confirmation by us. Additional charges may apply.

12. Changes or Cancellation by Us

In rare circumstances, we may need to cancel or change a booking due to reasons beyond our reasonable control, such as serious damage to the apartment, technical failure, legal restrictions, force majeure or other circumstances making the stay impossible or unreasonable.

In such cases, we will inform the guest as soon as reasonably possible and, where applicable, refund amounts paid for the affected stay. Further liability is limited to the amount paid for the booking, unless mandatory law provides otherwise.

13. Website Information

We aim to ensure that all information, descriptions, photos, prices and availability shown on the website are accurate and up to date. Minor differences in furniture, decoration, amenities or arrangement may occur.

Obvious errors, including pricing or availability errors, are not binding.

14. Data Protection

Personal data is processed in accordance with our Privacy Policy. Data may be processed for booking management, guest communication, payment handling, legal registration obligations, website operation and guest support.

15. Governing Law and Jurisdiction

These Terms and Conditions are governed by Austrian law, excluding conflict-of-law rules, unless mandatory consumer protection laws provide otherwise.

For business customers, the competent courts in Austria shall have jurisdiction. For consumers, the applicable statutory jurisdiction rules apply.

16. Severability

If any provision of these Terms and Conditions is invalid or unenforceable, the remaining provisions remain valid. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the intended economic purpose.
